Psychiatry Billing Problems: E/M + Psychotherapy Add-Ons and the MDM Coding Trap

Psychiatry billing sits at the intersection of two different coding systems — E/M (evaluation and management) and psychotherapy — and requires applying both correctly in a single encounter. Most psychiatrists either over-code the psychotherapy add-ons, under-code the E/M base level, or miss the interactive complexity add-on entirely. Any one of these errors is a compliance exposure or a revenue gap. All three together are systematic.

Problem 1: E/M + Psychotherapy Combined Billing

When a psychiatrist provides both psychotherapy and a medical E/M service in the same encounter — reviewing medications, managing a medical condition, assessing for side effects — both can be billed:

Code What It Covers Modifier Required
99213–99215 E/M service (medication management, medical assessment) Modifier 25 — significant separate E/M service
90833 Individual psychotherapy add-on (16–37 min) to E/M None — add-on code, billed with E/M
90836 Individual psychotherapy add-on (38–52 min) to E/M None — add-on code
90838 Individual psychotherapy add-on (53+ min) to E/M None — add-on code

The error pattern: billing a standalone psychotherapy code (90832/90834/90837) when a combined E/M + add-on should have been billed. Standalone psychotherapy pays less than E/M + add-on for equivalent time. A psychiatrist seeing a patient for 45 minutes of combined medical management and psychotherapy who bills 90834 (standalone, 38–52 min) is underbilling compared to 99214 + 90836 for the same encounter.

The compliance direction matters too: billing E/M + add-on when only psychotherapy was provided (no medical E/M service) is upcoding. The Modifier 25 on the E/M must reflect a genuine significant, separately identifiable medical service — not simply the prescription of medication that takes 2 minutes at the end of a therapy session.

Problem 2: MDM-Based Leveling for Psychiatry

Under the 2021 E/M revisions, office visit leveling uses Medical Decision Making or Total Time. For psychiatry, MDM-based leveling is often more favorable than time — but requires the documentation to support it.

A psychiatrist managing a patient with major depressive disorder on multiple medications, with risk assessment documented, and data review involving prior records: this is moderate MDM — a 99214. The same encounter billed based on time at 20 minutes is a 99213. The systematic under-coding happens when billers default to time when MDM would support a higher level.

Problem 3: Interactive Complexity (90785)

CPT 90785 is an add-on code for interactive complexity — applicable when any of four specified conditions are present: use of a legally authorized representative, evidence of or possible need to manage maladaptive communication, technical difficulty in providing care due to patient’s mental state, and family involvement in the service. This code pays $20–35 additional and is applicable on a significant portion of psychiatry encounters.

Most psychiatry practices never bill 90785. Not because their patients don’t qualify — many do — but because the biller doesn’t know the code exists or doesn’t know the qualifying criteria. It’s one of the most consistently unbilled legitimate add-on codes in behavioral health.

Frequently Asked Questions

Can a psychiatrist bill both E/M and psychotherapy?

Yes — when both a significant separately identifiable E/M service and psychotherapy are provided in the same encounter. Bill the E/M code with Modifier 25 and the appropriate psychotherapy add-on code (90833, 90836, or 90838 based on psychotherapy time). The E/M must be genuinely separate — medication management, medical assessment, risk evaluation — not the prescription alone.

What is the difference between 90832 and 90833?

90832 is a standalone individual psychotherapy code (16–37 minutes) billed when no E/M is provided. 90833 is the psychotherapy add-on code (16–37 minutes) billed alongside an E/M code when both services are provided. Use 90832 for therapy-only encounters. Use 90833 + E/M for combined medical management + therapy encounters.

What is interactive complexity in psychiatry billing?

CPT 90785 is an add-on code for interactive complexity — applicable when a legally authorized representative is involved, maladaptive communication requires management, the patient’s mental state creates technical care difficulty, or family involvement in treatment is a significant part of the service. It pays $20-35 additional and is separately reportable on qualifying encounters alongside E/M or psychotherapy codes.
